A total of 441 private establishments have violated Emiratisation rules since the second half of 2022, according to the Ministry of Human Resources and Emiratisation (Mohre).

According to Mohre, 436 establishments were fined for false emiratization, while five establishments circumvented targets.

Establishments that violated the law were penalized and sanctioned administratively. Nafis financial benefits had also been cut for UAE nationals who were proven to have been hired through fake Emiratisation tactics.

"Any violation of Emiratisation decisions will be dealt with firmly," the ministry stated.

The ministry also downgrades violating companies to the lowest category within the classification system for private sector establishments. This step comes with several consequences for private companies, including higher Mohre fees.

Serious violations are referred to the public prosecution for legal action, the ministry said. The authority also cancels the work permits of UAE nationals who were appointed falsely and orders violating establishments to pay the financial contributions as stated under Emiratisation policies.

“Nafis' financial support is aimed at empowering UAE nationals to be able to participate actively in the UAE's development process across various sectors, so we urge UAE nationals not to accept false Emiratisation jobs,” the ministry stated.

“We urge Emiratis in the private sector and the general public to report any violations related to Emiratisation decisions through our channels, either by contacting the Ministry's call center at 600590000 or by using the smart application."

According to Cabinet Resolution No. (44) of 2023 amending the provisions of Cabinet Resolution No. The initiative and programme of the Emirati Talent Competitiveness Council (NAFIS) have been subjected to a number of violations and administrative penalties since 2022 (95).

Companies that comply are lauded

Mohre praised private sector establishments that complied with Emiratisation decisions, calling them "partners in achieving Emiratisation objectives, which are a national priority, supported by wise leadership.".

Emiratisation, which aims to improve the UAE's human development system, develop productive Emirati human capital in the private sector, and ensure active participation of Emiratis in the national economy, was also stressed by the ministry.
